Section 3 · Project Residents

Jobs and contracts where we rebuild.

Partners in Construction, Inc. posts Section 3 opportunities for low- and very low-income residents, and for businesses that hire them, on HUD-funded recovery work.

The job-site notice is available as a posted notice (PDF).

What Section 3 is

A hiring and contracting rule on HUD-funded work.

Section 3 is part of the Housing and Urban Development Act of 1968 (12 U.S.C. 1701u). When certain HUD funds pay for a project, the jobs, training, and contracting from that money should go, to the greatest extent feasible, to low- and very low-income people. People who receive government help with housing, and people who live where the money is spent, come first. Businesses that give work to those people are included. HUD's current rule is 24 CFR Part 75.

The notice posted for project residents says the same thing in short form. It tells the public, and especially project residents, about jobs created by the federal award. Section 3 does not guarantee a job or a contract. You still have to meet the qualifications of the work, and a business still has to meet the contract. A prior arrest or conviction does not, by itself, remove Section 3 worker or Section 3 business status.

Who qualifies

Three ways HUD describes Section 3 status.

These definitions are for housing and community development assistance, including CDBG-DR. Income limits depend on county and household size. HUD publishes them at HUD income limits.

Section 3 worker

A worker who, now or when hired within the past five years, fit at least one of these and can document it: income for the previous year, or annualized income for the current year, is below the limit HUD sets; the worker is employed by a Section 3 business concern; or the worker is a YouthBuild participant.

Targeted Section 3 worker

A Section 3 worker who is also employed by a Section 3 business concern, lives in the service area or neighborhood of the project (now or when hired within the past five years), or is a YouthBuild participant. The service area is within one mile of the project. If fewer than 5,000 people live inside that mile, it is a circle around the project large enough to include about 5,000 people, using the most recent U.S. Census.

Section 3 business concern

A business that, documented within the last six months, met at least one of these: at least 51 percent owned and controlled by low- or very low-income persons; over 75 percent of the labor hours in the prior three months were worked by Section 3 workers; or at least 51 percent owned and controlled by current public housing residents or by residents who currently live in Section 8-assisted housing.

Posted notice

Preferences on the job-site notice.

The notice Partners in Construction posts on the job site lists these Section 3 preferences, in this order.

01Persons residing in the project area who are of low- to very-low-income.
02Participants in HUD Youthbuild.
03Homeless persons.
04Residents of the local Public Housing Authority.
05Residents of the local Section 8 Housing Assistance Program units.
